Terms & Conditions — Legal Framework Governing Use of the Cheap Cigarettes Platform

These Terms and Conditions (“Terms”) set out the legal framework under which the Cheap Cigarettes platform (“the Store,” “the Platform”) is made available to adult purchasers (“Purchasers,” “you”). They govern the use of the website, the placement and processing of orders across all product categories carried in the store, and the resolution of any dispute arising from that use.

Access to this platform, and to these Terms, is restricted to persons who satisfy the minimum legal tobacco acquisition age in their jurisdiction of residence. By accessing the platform, browsing the catalog, placing an order, or completing a transaction, you confirm that you satisfy this requirement and accept these Terms in full.

1. Definitions

For the purpose of these Terms, the following definitions apply:

  • “The Store,” “the Platform,” “Cheap Cigarettes,” “we,” “us,” “our” — the online retail platform operated by KING SMOKE sp. z o.o. at cheap-cigarettes.org.
  • “Purchaser,” “you,” “your” — any adult person who accesses the platform, browses the catalog, places an order, or completes a transaction.
  • “Product,” “item,” “listing” — any factory-rolled cigarette, hand-rolling tobacco blend, cigarillo, or additional format listed for sale in the store catalog.
  • “Order” — a request submitted by a Purchaser through the checkout process to acquire one or more items.
  • “Dispatch” — the transfer of a completed order from the origin fulfillment facility to the registered postal operator for international transit.
  • “Applicable Law” — the laws, regulations, and directives of the destination jurisdiction, and of the jurisdiction of KING SMOKE sp. z o.o. incorporation, as amended from time to time.

2. Acceptance of Terms

By accessing the platform, browsing the catalog, placing an order, or completing a transaction, you confirm that you have read, understood, and accepted these Terms in full, together with the additional policies incorporated by reference under Section 27.

If you do not accept any provision of these Terms, you are required to discontinue use of the platform. Continued use after publication of a revised version of these Terms constitutes acceptance of the revised terms, subject to the amendment procedure set out at Section 27.


3. Age Verification and Eligibility

Access to, and acquisition of, tobacco products through this commercial platform is restricted to persons who satisfy the minimum legal tobacco acquisition age applicable in their jurisdiction of residence.

The minimum age threshold enforced on this platform is 21 years. Where applicable local legislation establishes a higher minimum age threshold, that higher standard governs.

Mandatory age verification is applied at the transaction stage as a condition of purchase completion across all product categories. No transaction may be completed in the absence of satisfaction of the applicable age verification requirement.

The Purchaser confirms, by placement of an order, that the information provided for age verification is accurate. The Platform reserves the right to refuse or cancel any transaction where age verification cannot be satisfied. Where an order is subsequently found to have been placed by a person below the applicable minimum age, the order is void and any dispatched consignment may be recalled. Circumvention of the age verification process by any means is prohibited.


4. Scope of Sale and Product Categories

The Store operates as a specialized retailer of three regulated tobacco categories: factory-rolled cigarettes, hand-rolling tobacco blends, and cigarillos. Additional categories, where introduced, are governed by the same Terms unless expressly stated otherwise on the applicable product pages.

All items listed are sourced through documented international supply channels and carry original factory labeling with declared tar, nicotine, and carbon monoxide yield data as required under applicable regulatory labeling frameworks.

Product availability and eligibility for dispatch to a specific destination are determined at the checkout stage, on the basis of the declared delivery jurisdiction and the applicable regional restrictions. Menthol-characterized items are prohibited for dispatch to the European Union (Directive 2014/40/EU, effective 20 May 2020), the United Kingdom, and additional jurisdictions listed at the destination eligibility screen.


5. Order Placement and Order Acceptance

Submission of an order through the checkout process constitutes an offer by the Purchaser to acquire the selected items on the terms set out in these Terms. Acceptance of the offer, and formation of a binding contract of sale, occurs upon issuance of the order confirmation and payment clearance, subject to the following conditions:

  • Availability of the ordered items at the time of processing;
  • Successful age verification at the transaction stage;
  • Successful payment clearance in accordance with the applicable payment method;
  • Confirmation of destination eligibility for every item in the order;
  • Compliance of the Purchaser’s declared details with the requirements of the payment provider and, where applicable, the destination customs framework.

The Platform reserves the right to decline or cancel any order at any time prior to dispatch. Where an order is declined after payment has cleared, any received funds are returned to the original payment method in accordance with the Refund and Returns Policy.


6. Pricing, Currency, and Pricing Errors

All prices are displayed in United States Dollars (USD) at the point of order placement. Applicable shipping cost and estimated customs duty, where displayed, are calculated at the checkout stage on the basis of the declared destination and the order composition.

Prices reflect direct procurement cost and are subject to change without notice; the price applicable to any given order is the price displayed at the moment of order placement, subject to the pricing error provision below.

In the event that an item is displayed on the Store at a price that is manifestly incorrect due to a typographical error, a system error, or a data feed error, the Platform reserves the right to cancel the affected order line at no cost to the Purchaser. Where such a cancellation occurs after payment clearance, the affected amount is returned to the original payment method. This provision does not affect any correctly-priced items in the same order.


7. Payment Terms

Payment methods accepted at checkout include card payments (Visa, Mastercard, American Express) processed through a PCI-DSS compliant acquiring gateway with mandatory 3D Secure authentication; PayPal, subject to the returning-customer eligibility rules; Revolut through direct acquiring integration; and cryptocurrency in the assets and networks confirmed at the checkout stage.

Complete payment terms, including processing windows, quote-lock provisions for cryptocurrency, security standards, and payment-method-specific refund reconciliation, are set out in the Payment Methods policy, which is incorporated into these Terms by reference.

Placement of an order constitutes authorisation of the applicable charge to the selected payment method. No dispatch is initiated in the absence of payment clearance in accordance with the Payment Methods policy.


8. Shipping and Delivery

Dispatch is executed through registered international postal channels with a carrier tracking identifier issued on every consignment. Delivery timelines are declared as reference ranges and are not guaranteed, in accordance with documented cross-border logistics conditions and destination-side customs processing.

Complete shipping terms, including dispatch options, transit windows, tracking issuance, customs processing procedure, restricted destinations, and delivery-scenario resolution procedures, are set out in the Shipping Policy, which is incorporated into these Terms by reference.


9. Import Compliance and Customs Responsibility

Tobacco products across all categories listed on this platform are regulated goods subject to import controls in every jurisdiction served. The Purchaser bears sole legal responsibility for confirming the following prior to placing an order:

  • The specific product format ordered is lawfully importable at the declared destination;
  • The order quantity does not exceed the applicable personal import allowance under the destination customs framework;
  • All customs duties, excise taxes, and import levies payable upon receipt will be remitted in compliance with local tax obligations;
  • No prohibited items (including menthol-characterized products where applicable) are included in orders destined for jurisdictions where such items are prohibited.

This platform does not facilitate customs evasion and does not provide advisory services on the avoidance of lawful declaration requirements. Placement of an order constitutes acceptance by the Purchaser of sole legal responsibility for import compliance at the declared destination.


10. Refunds and Returns

Complete refund and return terms, including the 45-day refund guarantee, the extended non-delivery provision, damage reporting procedures, product-integrity exclusions, and reshipment framework, are set out in the Refund and Returns Policy, which is incorporated into these Terms by reference.

Approved refunds are returned to the original payment method used at checkout in accordance with the payment-method-specific reconciliation set out in the Payment Methods policy.


11. Personal Use and Resale Prohibition

All items acquired through the Store are sold exclusively for personal use by the Purchaser or by adult members of the Purchaser’s household who satisfy the applicable minimum tobacco acquisition age. Resale of items acquired through the Store, whether to individuals or to commercial entities, is prohibited.

The Platform accepts no liability, civil, regulatory, or otherwise, for any consequence arising from the resale of items acquired through the Store in breach of this provision. Orders identified as intended for resale may be cancelled at any time, and repeat breaches may result in the suspension of the Purchaser’s ability to place further orders.


12. Chargebacks and Payment Disputes

Purchasers experiencing an order-stage or delivery-stage issue are directed to the claim framework set out in the Refund and Returns Policy as the primary resolution channel. Structured claim submission through this channel typically results in faster and more complete resolution than a card-scheme chargeback initiated in parallel.

Card-scheme consumer protections available to the Purchaser under the applicable card network rules are not affected by these Terms. Where a chargeback is initiated during an active claim review, the claim review window is extended to allow for coordination with the acquiring bank. Documented resolution offers made prior to the initiation of a chargeback are retained on the account record.

Chargebacks initiated in the absence of a documented delivery-stage or product-integrity issue, and without prior contact with the Refund and Returns claim channel, may result in the suspension of the Purchaser’s ability to place further orders on the Platform, in the interest of protecting the operational continuity of the Store.


13. Product Information and Manufacturing Specifications

Product listings state the format, cut classification, wrapper type, blend composition, pack size, and declared tar, nicotine, and carbon monoxide yield figures as printed on factory packaging in accordance with applicable regulatory labeling requirements. Descriptions state what a product is as a matter of factory specification and do not assign subjective quality characterizations.

Where a brand carries a factory notation such as “no manufacturing additives,” it is presented as a product specification notation registered with the applicable regulatory authority and not as a health characterization. No claim of reduced risk, modified risk, or health benefit is made by this platform in respect of any product listed in the catalog.

The Platform sources items exclusively through documented international supply channels carrying original factory labeling. In the event of any manufacturer-side variation between production runs of the same product line, such variation is a manufacturer matter and does not, on its own, constitute grounds for refund under the Refund and Returns Policy unless the declared specification on the packaging materially differs from the specification stated on the product listing at the time of order.


14. Prohibited Uses of the Platform

Purchasers may not use the platform for any of the following purposes:

  • Placement of orders for resale (see Section 11);
  • Placement of orders on behalf of a person below the applicable minimum tobacco acquisition age;
  • Circumvention of the age verification process by any means;
  • Circumvention of the destination eligibility check to obtain dispatch of a prohibited item to a restricted jurisdiction;
  • Attempts to interfere with the operation, security, or integrity of the platform;
  • Automated scraping, harvesting, or crawling of the catalog other than by permitted search engine indexing;
  • Uploading of malicious code, viruses, or content intended to compromise the platform or its users;
  • Use of the platform in violation of any applicable law of the Purchaser’s jurisdiction of residence or of the destination jurisdiction.

Breach of any of the above may result in the suspension or termination of the Purchaser’s access to the platform and, where applicable, in the reporting of the breach to competent authorities.


15. User Accounts and Security

Where the Purchaser creates an account on the platform, the Purchaser is responsible for maintaining the confidentiality of the account credentials and for all activity conducted under the account. The Purchaser is required to notify support without undue delay in the event of any unauthorised access or suspected compromise of the account.

The Platform reserves the right to suspend or terminate any account in the event of a breach of these Terms, of a suspected fraud pattern, or where account activity is inconsistent with the personal-use scope of the Store.


16. Intellectual Property

All original content on the platform, including but not limited to the store name and logo, product descriptions authored by the Store, technical reference guides, comparison tables, editorial content, and photographic materials produced for the Store, is the intellectual property of KING SMOKE sp. z o.o. or is licensed to KING SMOKE sp. z o.o..

Purchasers are granted a limited, non-exclusive, non-transferable licence to access and view this content for the purpose of browsing the catalog and completing personal-use orders. Reproduction, distribution, modification, or commercial use of this content without prior written authorisation is prohibited.

Where the Purchaser submits content to the platform, including customer reviews, feedback, or other communications, the Purchaser grants KING SMOKE sp. z o.o. a non-exclusive, worldwide, royalty-free licence to use, display, and adapt the submitted content for the purposes of platform operation, provided that any personally identifying information is handled in accordance with the data protection provisions of Section 18.


17. Third-Party Trademarks and DMCA Procedure

All registered trademarks, brand names, and logos of tobacco manufacturers and cigarette, tobacco, or cigarillo brands referenced on the platform are the property of their respective owners. References to such trademarks on the platform are made for the purpose of identifying the specific product listed for sale, in accordance with the doctrine of nominative fair use. No affiliation, endorsement, or partnership with the trademark owners is implied by the presence of such references.

Rights holders who believe that content on the platform infringes their intellectual property rights may submit a takedown notice to the designated agent identified in Section 29 of these Terms. Notices should include:

  • Identification of the copyrighted or trademarked work claimed to be infringed;
  • Identification of the material on the platform claimed to be infringing, with sufficient detail to permit location of the material;
  • Contact information for the notifying party;
  • A statement that the notifying party has a good-faith belief that the use is not authorised;
  • A statement, under penalty of perjury, that the information in the notice is accurate and that the notifying party is authorised to act on behalf of the rights holder.

The Platform will act on properly-formed takedown notices in accordance with applicable law.


18. Data Protection and Privacy

Personal data provided by the Purchaser in the course of registration, order placement, age verification, payment, and customer support is processed in accordance with the Platform’s Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy sets out the categories of data collected, the purposes of processing, the categories of recipients (including payment processors, shipping carriers, and, where legally required, customs and tax authorities), applicable retention periods, and the data subject rights available under the applicable data protection framework, including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) where relevant.

Data subject requests, including requests for access, rectification, deletion, and portability, should be submitted to the contact address stated in the Privacy Policy.


19. Website Availability and Service Interruptions

The Platform is provided on an “as available” basis. While the Platform seeks to maintain continuous availability, no warranty is made that the website will be uninterrupted, error-free, or free from security incidents, viruses, or other harmful components. Scheduled maintenance, unscheduled downtime, and technical failures may occur.

The Platform is not liable for any inability to access the website, to place an order, or to complete a transaction resulting from an interruption of service beyond its reasonable control.


20. Limitation of Liability

To the maximum extent permitted by applicable law, and without limiting any non-excludable statutory rights of the Purchaser, the aggregate liability of KING SMOKE sp. z o.o. in respect of any claim arising from or in connection with an order placed on the Platform is limited to the amount paid by the Purchaser for the affected order.

The Platform is not liable for any indirect, consequential, incidental, or special losses, including but not limited to loss of profit, loss of business opportunity, or loss arising from a customs seizure at the destination outside the scenarios covered by the Refund and Returns Policy.

This Section does not affect any liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, or death or personal injury caused by proven negligence of the Platform.


21. Indemnification

The Purchaser agrees to indemnify and hold harmless KING SMOKE sp. z o.o., its officers, employees, and authorised agents from and against any claim, liability, or expense (including reasonable legal costs) arising from:

  • A breach by the Purchaser of these Terms;
  • A breach by the Purchaser of applicable law, including import, customs, and tax law at the destination;
  • The resale of items acquired through the Store in breach of Section 11;
  • Circumvention of the age verification process or of destination eligibility checks;
  • Fraudulent or unauthorised use of a payment method under the Purchaser’s control.

22. Force Majeure

The Platform is not liable for any delay in performance, or for any failure to perform, arising from an event beyond its reasonable control. Such events include, without limitation: acts of government or regulatory authority; changes in applicable tobacco, customs, or postal legislation; postal-channel disruptions; customs-facility backlogs; carrier-network incidents; natural disaster; armed conflict; industrial action; large-scale infrastructure failure; and public health emergencies affecting international logistics.

Where an event of force majeure prevents dispatch of a consignment for a period exceeding the applicable transit window, the affected order is treated under the non-delivery provision of the Refund and Returns Policy.


23. Governing Law

These Terms are governed by, and interpreted in accordance with, the laws of , without regard to conflict-of-laws principles that would result in the application of the laws of another jurisdiction.

Nothing in this Section deprives the Purchaser of the benefit of any mandatory consumer protection provision available under the laws of the Purchaser’s jurisdiction of residence.


24. Dispute Resolution

Any dispute arising from or in connection with these Terms is subject to the following resolution procedure:

  1. Initial resolution. The Purchaser is directed to contact the Legal & Compliance Team at the address stated in Section 29, with a description of the dispute and any supporting documentation.
  2. Good-faith negotiation. The Parties shall use reasonable efforts to resolve the dispute through good-faith negotiation within 30 calendar days of the notice.
  3. Alternative dispute resolution for consumers. Where the Purchaser is a consumer resident in the European Union, the Purchaser may submit the dispute to the online dispute resolution platform operated by the European Commission at https://ec.europa.eu/consumers/odr/, in accordance with Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes. This procedure is voluntary and does not affect the Purchaser’s right to pursue formal proceedings.
  4. Formal proceedings. Where the dispute cannot be resolved through negotiation or alternative dispute resolution, the dispute shall be submitted to the exclusive jurisdiction of the common courts of the Republic of Poland competent for the registered office of KING SMOKE sp. z o.o. in Warsaw, save that a Purchaser acting as a consumer retains the right to bring proceedings in the courts of the Purchaser’s country of residence where such right is granted by mandatory consumer protection law applicable to the Purchaser, including under Section 4 of Regulation (EU) No 1215/2012 (Brussels I recast).

This Section does not prevent either party from seeking urgent injunctive or equitable relief in a court of competent jurisdiction where necessary to protect its rights pending resolution of the dispute.


25. Severability, Entire Agreement, No Waiver, Assignment

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, the remaining provisions of these Terms continue in full force and effect.

Entire agreement. These Terms, together with the Shipping Policy, the Refund and Returns Policy, the Payment Methods policy, and the Privacy Policy incorporated by reference, constitute the entire agreement between the Purchaser and KING SMOKE sp. z o.o. in respect of orders placed on the Platform and supersede any prior representation, understanding, or arrangement between the parties in respect of the same subject matter.

No waiver. A failure or delay by KING SMOKE sp. z o.o. to enforce any provision of these Terms does not constitute a waiver of that provision or of the right to enforce it on any subsequent occasion.

Assignment. The Purchaser may not assign or transfer any rights or obligations under these Terms without the prior written consent of Cigarettes JDG may assign these Terms to a successor entity in the event of a corporate transaction, subject to the successor entity being bound by these Terms on materially the same basis.


26. Notice Provisions

Notices to KING SMOKE sp. z o.o. in connection with these Terms should be submitted in writing to the Legal & Compliance Team at the address stated in Section 29. Notices to the Purchaser will be transmitted through the registered contact address associated with the Purchaser’s account or order record. A notice is deemed received on the business day following transmission where transmitted by electronic means.


27. Amendments and Effective Dates

These Terms may be amended by KING SMOKE sp. z o.o. to reflect changes in applicable law, in operational practice, in payment or shipping provider terms, or in the scope of the platform. Material changes will be identified in the changelog at Section 30 of this page, with an effective date not less than 14 calendar days from the date of publication of the revised Terms.

Continued use of the platform after the effective date of a revised version constitutes acceptance of the revised Terms. Purchasers who do not accept the revised Terms are required to discontinue use of the platform prior to the effective date. Orders placed under a prior version of these Terms remain governed by the version in force at the time of order placement, save that any provision required by mandatory applicable law shall apply.

The following policies are incorporated into these Terms by reference and apply on the terms set out in each: the Shipping Policy, the Refund and Returns Policy, the Payment Methods policy, and the Privacy Policy. In the event of a conflict between these Terms and a policy incorporated by reference, the incorporated policy controls in respect of its specific subject matter.


28. Health Declaration

All tobacco products, including those available through this platform, carry significant documented health risks. Consumption of tobacco products has been causally linked to severe preventable disease. No claim of reduced risk, modified risk, or health benefit is made by this platform in respect of any product listed in the catalog.
